You’ve probably heard that for most property transactions, the lawyer or conveyancing professional instructed carries out a “search” as part of the process.

Its one of the areas we can save time on as we work with lots of different local authorities combined with good local knowledge of , so we know what search you’ll need for properties that can be actioned on day one to speed the process up.

But what is actually in a property search and what’s the benefit of having the searches completed properly?

1) Local Authority Search

Your Local Authority Search is made up of two parts; the LLC1 and the CON29. These are normally submitted together with a location plan by your conveyancer, covering the property in question only:

LLC1 Search – Form LLC1 is a search of the local land charges register and will identify specifics to the property in question, and its location environment. Is the property a listed building? Is it in a conservation or smoke control zone? Are there any trees on the property that are protected? These and any other questions will be identified in the LLC1 search.

CON29 Search – The CON29 search finds anything in the public domain concerning proposed future plans that could affect the property. Are there any compulsory purchase orders that affect the property? Are there any proposed tree preservation orders? Are there any new road or major building developments planned? These and several others may come up only by conducting a CON29 Search

2) Water Drainage Search

A Water Drainage Search is conducted to confirm whether the property is connected to a public sewer, septic tank or other private disposal facilities. It will also confirm if the property is connected to a public or private water supply and provide details of how the property is billed for its water supply and wastewater disposal (either rateable value or water meter). Finally the report will confirm if the property is close to or affected by water mains or public sewers.

3) Environmental Search

An environmental search checks the past land use records relating to the area, to check whether the land is likely to be contaminated land within the meaning of the Environmental Protection Act 1990.

4) Additional searches

Depending on the type of property and its location, there may need to be additional searches completed, such as mining searches. If you have any concerns about the property and its location, do tell your conveyancer or iConvey Legal Secretary so we can get it checked out for you.
